The Luck of the Draw

Charles Chauvel and I were pleased when our bill to repeal the defence of provocation was drawn from the ballot after holding it back to avoid the two high profile trials that dominated recent headlines.  But we were even more pleased to receive a copy of the government bill that was virtually a word-for-word copy.  Given that the government had already scrapped the Sentencing Council and ruled out the sentencing guidelines approach we had been working on in government, we had been worried that the government would go down the track of re-creating the problem by, for example, asking the jury to decide on degrees of murder.   Fortunately they have not gone down that track and opted for a straight repeal, and given that essentially the same bill cannot be voted on twice in a year, it made sense to let the government bill take precedence.  We therefore made the decision to withdraw the private member’s bill from the Order Paper, which has allowed another bill to be drawn from the ballot.  With the government bill in play, there is now no question that the repeal will now have the overwhelming support of Parliament .  I call that a win-win!
